9 People Arrested In 2 Marijuana Busts In Elk Grove A Week Apart

The Elk Grove Police Department has been quite busy with marijuana busts lately. In the space of approximately a week’s time, between December 14 and December 20,  9 individuals were arrested. Search warrants were served on a total of 13 houses.

On December 14, Elk Grove Police served search warrants on 6 different Elk Grove homes. They arrested Haiying Lin (30),  Jia Weng (59), Wenxing Weng (33),  Li Chen (55),  Mei Zhou (54),  Xinglong Lin (50), and Jin Qui (61).

The charges are listed as:

  1. FELONY MANAGEMENT/PLACE USED MANUFACTURE/STORE CONTROLLED SUBSTANCE
  2. POSSESSION FOR PURPOSE OF SALE
  3. MISDEMEANOR PLANT/CULTIVATE/HARVEST/DRY/PROCESS > SIX MARIJUANA PLANTS

Approximately 6 days later,  Elk Grove Police served search warrants at 7 area homes on Wednesday December 20. They arrested Pin Wang, (54) and Qingfen Han (43) of Elk Grove.

The  charges are listed as:

  1. FELONY MANAGEMENT/PLACE USED MANUFACTURE/STORE CONTROLLED SUBSTANCE
  2. FELONY POSSESSION FOR SALE-MARIJUANA/HASHISH
  3. MISDEMEANOR PLANT/CULTIVATE/HARVEST/DRY/PROCESS > SIX MARIJUANA PLANTS

The aforementioned individuals have not yet been convicted of the crimes for which they were arrested. As of December 20, all 9 individuals remain the the Sacramento County Jail.

As of January 2018, marijuana will be legal to use in the State of California.

The City of Elk Grove only allows personal cultivation of up to 6 marijuana plants in a private residence, or associated accessory structure.  In March of 2017, and in response to Proposition 64, the City of Elk Grove made changes to its Municipal Code (Chapter 23.83) to impose regulations on personal indoor marijuana cultivation and clarify permissible land uses.  The City’s regulations include the following:

  • You may not have more than 6 plants of marijuana as stated by California State Law
  • Marijuana may not be cultivated or accessible to persons under 21 years of age
  • Commercial cultivation, testing, or retail sale of marijuana within the City of Elk Grove is prohibited
  • Indoor personal cultivation of marijuana is limited to no more than six marijuana plants per residence
  • The person cultivating marijuana must be a full-time resident at the location where the marijuana is being grown
  • All outdoor cultivation of marijuana is prohibited in the City of Elk Grove
  • Personal cultivation is only permitted in a private residence or associated accessory structure
  • No marijuana growing operation can be constructed in violation of applicable codes governing structures, including the City Zoning Code, the Building Code, Electrical Code, and Fire Code
  • Grow lighting in excess of 1,200 watts per residence is prohibited
  • Indoor use of generators or gas products in the cultivation activity is prohibited
  • Personal cultivation performed in a residence must be done in a manner that does not alter the primary use of any kitchen, bathroom, or bedroom
  • Private residences or accessory structures in which the marijuana is cultivated must be locked except when in use
  • Cultivation activity cannot be visible from the public right-of way
  • Marijuana cultivation in any rented residence is prohibited without express consent of the owner
  • Emission of odors in violation of the City’s Code is prohibited
